In consideration of us allowing you to use this site and its services, you agree not to do anything illegal, immoral, harmful, annoying, or unethical to, on, or through our site, nor to place undue burden on our site, servers, or resources. You agree not to "scrape" the site, perform automated searches, or perform bulk downloads of data or images in any manner not specifically sanctioned by us through the standard search and download interfaces we make available for those purposes, nor to circumvent any interface we set up (including, but not limited to creating automated scripts or directly accessing back-end interfaces or APIs without permission instead of manually using the web forms as intended). You also agree not to do automated transcription or uploading of data without express permission. You agree not to access our site or data in any manner beyond what is clearly intended by us.

You dedicate your Open Genealogy Data transcriptions to the public domain under the Creative Commons CC0 1.0 Public Domain Dedication.

The web-based transcription system is hosted on the Historic Journals website (hjournals.com). If you transcribe, you may transcribe as a guest, or you may transcribe as a logged-in user via your Historic Journals account. In either case, the terms of use and privacy policy of the Historic Journals website apply. Both hjournals.com and OpenGenData.org are sponsored and operated by Historic Journals LLC, and personal information may be shared between the two websites.

You agree not to intentionally transcribe, upload, or provide false, erroneous, misleading, or otherwise inappropriate information. You agree to follow our transcription instructions and conventions.

You agree to only use the data, images, software, or other information on our site in accordance with any license, copyright, or restrictions applicable to the data, images, software, or information. For data, images, or other information marked "public domain" or "no known restrictions," that means we believe there is no current copyright in the United States and we place no license restrictions of our own on its use or redistribution. However, you are responsible for your own determination of copyright and all other rights, which may vary by country and juristiction, and may include rights other than copyright such as personal rights or privacy-related rights or other restrictions that we are not aware of.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, OUR SITE, SERVICES, DATA, INFORMATION, AND PRODUCTS ARE PROVIDED "AS IS" WITHOUT ANY GUARANTEE OR WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, OTHER THAN THOSE EXPLICITLY STATED IN THIS AGREEMENT. WE ALSO DISCLAIM LIABILITY FOR ANY DAMAGES, WHETHER DIRECT OR INDIRECT, THAT OCCUR AS A RESULT OF YOUR USE, MISUSE, OR INABILITY TO USE OUR PRODUCTS, SERVICES, INFORMATION, SOFTWARE, OR SUBSCRIPTIONS, OR RESULTING FROM ERRORS IN THE SERVICES OR PRODUCTS OR INFORMATION OR DATA. Jurisdiction and Applicable Law: This Agreement shall be governed by the laws of the State of Utah, United States of America.

Separability: If any portion, term, or provision of the Agreement is found to be unlawful, unenforceable, or invalid, the remainder of the Agreement remains in effect and you agree to abide by it.
